How Civil Litigation Works in Thailand
Pre-litigation Claim and Negotiations
Before filing a lawsuit, we prepare a formal claim, establish our client’s position, conduct negotiations, and attempt to resolve the dispute out of court. This often saves time and money.
Filing the Lawsuit
If a settlement cannot be reached, we file the case with the court (filing online is also possible). We prepare documents, collect evidence, and register the case.
Preliminary Examination
The court may schedule a preliminary hearing to assess the validity and merits of the claim.
Mediation
Mediation is a mandatory stage. The court will require both parties to attempt to mediate the dispute. Based on our experience, around 70% of our clients’ cases are resolved at this stage, without going to trial.
Trial (Court Hearings)
Main hearings take place — usually at least two: one for each side. The court hears witnesses and evaluates evidence.
Judgment
The judge sets a date to announce the decision. After that, the parties can receive a copy of the judgment and, if necessary, file an appeal.
Enforcement of Judgment
We obtain a writ of execution, file with enforcement officers, and oversee the actual enforcement — seizure of assets, eviction, or other measures.
